Wrongful Death
Tennessee Wrongful Death Cases
A Tennessee wrongful death case is filed on behalf of the deceased by either a parent of the decedent, a spouse of the decedent, a child or children of the decedent or other qualifying party to assert the rights the deceased would have had against the wrongdoer had death not ensued. Wrongful death cases are a unique type of recovery allowed when, for instance, a Franklin car wreck , tractor trailer crash , downtown construction accident , slip and fall , negligent Nashville nursing home, or other type of tort causes a death.

What type of compensation is available in a Tennessee wrongful death case?
The right to a money award for wrongful death is strictly by statute in Tennessee. A wrongful death case in Tennessee has two types of money damages that may be awarded. The first class deals with the damages sustained by the injured party, including compensation for the following:
- The mental and physical suffering actually endured by the injured person between the injury and death;
- Medical expenses incurred as result of injuries before death, including expenses for doctors, nurses, hospital care, medicine and drugs;
- Funeral and burial expenses; and
- Loss of earning capacity and the ability to earn money during the period from injury to death.
The second class of money damages that may be awarded in a Tennessee negligent death case is the present cash value of the pecuniary value of the life of the deceased. In determining this value, the court or jury considers the following factors:
- The age of the deceased;
- The condition of health of the victim of wrongful death in Tennessee;
- The life expectancy of the deceased;
- The strength and capacity of the deceased for work and for earing money through skill in any art, trade, profession, occupation, or business;
- The personal habits of the deceased as to sobriety and industry; and
- The reasonably value of the loss of consortium suffered by the wife, children of the deceased.
What is consortium?
- Consortium is a legal term consisting of many things. It includes both tangible services provided by a family member, as well as intangible benefits each family member receives from the continued existence of other family members. Examples of intangible benefits include love, affection, attention, education, guidance, care, protection, training, companionship and cooperation that the spouse and/or children would reasonably be certain to have received during the life of the deceased.
- Damages for loss of consortium are not a separate action, but may be considered when calculating the pecuniary value of a deceased’s life. This unique area of law requires an experienced injury and careless death attorney to accurately prove and portray this claim to the jury.
Who can file a Tennessee careless death case?
- Tennessee law only permits certain individuals to file a wrongful death suit on behalf of a deceased.
- If you have lost a spouse or a parent due to someone else’s negligence, please contact Larry R. Williams, Jonathan Williams and/or their staff to see if you can bring a Tennessee death lawsuit on their behalf.
